Acceptance and application of the conditions

The present conditions of sale are concluded on the one hand by Sarl Dufil with a capital of 5000 euro whose registered office is at 17, Le Petit Noyan, 35440 Montreuil-sur-Ille, registered in the trade and companies register of Rennes under the number 487 999 864 hereinafter referred to as "Penn'Ty Bio" and on the other hand, by any natural or legal person wishing to make a purchase via the website "www.penntybio.com" hereinafter referred to as "l 'Buyer".

These conditions of sale are intended to define the contractual relationship between Penn'Ty Bio and the buyer and the conditions applicable to any purchase made through the commercial site www.penntybio.com whether the buyer is a professional or a consumer.

The buyer acknowledges having the capacity to contract under the conditions described below, ie being of legal majority and not being under guardianship or curatorship. The buyer acknowledges having read these T&Cs before placing the order.

The acquisition of a property through this site implies unreserved acceptance by the buyer of these General Conditions of Sale. These conditions of sale shall prevail over any other general or specific conditions not expressly approved by Penn'Ty Bio.

Penn'Ty Bio reserves the right to be able to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer. This contract is subject to French law.



The prices of our products are indicated in euros including VAT, taking into account the VAT applicable on the day of the order. Any change in the rate may be passed on to the price of the products.

Penn'Ty Bio reserves the right to modify its prices at any time, it being understood, however, that the products will be invoiced on the basis of the prices in force at the time the orders are recorded, subject to availability. The products remain the property of Penn'Ty Bio until full payment of the price.

When ordering online, the total price indicated in the order confirmation includes the price of the products as well as any transport costs.

Customs taxes and dock dues

We draw your attention to the fact that, for shipments of parcels outside the European Union and in the DOM TOM, the invoicing of the products is exclusive of tax. Customs fees + dock dues may then be charged by the country of destination. These customs duties, VAT and dock dues (DOM TOM) are not included in the sale price and must be paid in addition upon receipt of the package in your territory. Orders are placed via the website: www.penntybio.com.

Validation of the order entails acceptance of these General Terms and Conditions of Sale, acknowledgment of having perfect knowledge of them and waiver of the right to avail oneself of its own conditions of purchase or other conditions.

The automatic registration systems communicated via the Internet are considered as proof of the nature, content and date of the order.

The validation of the order will be worth signature and acceptance of the operations carried out. Any validation of an order entails the obligation to pay for the order in question.

Penn'Ty Bio will confirm the registration of his order to the buyer at the e-mail address that he will have communicated.

Penntybio.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to payment for a previous order.

Orders for an amount equal to or greater than €120 are archived by Penn'Ty Bio for a period of 10 years from the date of the order. The buyer who wishes can access his orders either by making the request via the contact form, or by consulting his user account.


Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks.

In this context, indications on the availability of products are provided to you when placing your order. This information coming directly from our suppliers, errors or modifications may exceptionally exist.

In the event of temporary unavailability, Penn'Ty Bio reserves an additional two weeks to process the order. In the event of the definitive unavailability of a product after placing the order, the buyer will be informed by e-mail or telephone of the items out of order. The buyer will then have one working week (excluding weekends and public holidays) to request the cancellation or exchange of his order by contacting our customer service exclusively by e-mail at contact@penntybio.com.

After this period and if no request was noted on the part of the buyer, the order will then be sent with the available items and only these items will be invoiced. In this case, Penn'Ty Bio will not manage the remainder of the order.

For payment by check, in the event of unavailability of all or part of the order, reimbursement will be made by check at the latest within 15 days of payment of the sums paid by the customer.

Penn'Ty Bio cannot be held liable towards the customer in the event of temporary or permanent unavailability of products.


Delivery time

Available products are shipped by parcel from Monday to Saturday. The shipping time is a maximum of 48 hours after validation of your order. The average delay observed is 24 hours.

An order will only be dispatched after its payment: receipt of the check or validation by the bank of the bank payment.

In case of deferred payment (cheque, bank transfer), the order will be processed upon receipt of payment. Consequently, the deadlines applicable in this case are those on the day of receipt of payment. The availability of the products is indicated at the time of placing the order. Penn'Ty Bio cannot be held responsible for the unavailability of products upon receipt of payment.



The order will be shipped to the delivery address indicated by the buyer during the ordering process. In the event of an error in the recipient's details, Penn'Ty Bio cannot be held responsible for the impossibility of delivering the package. The shipping costs indicated on the order form are inclusive of VAT. Any delays do not entitle the buyer to claim damages.

In addition, if a product is missing from your package when you open it, you can contact us by email or telephone. We kindly ask you to keep the packaging box for the duration of the claim. You may be asked for photographs of it.


Delivery time

To reduce transport costs as much as possible, all our products are sent by the post office Colissimo Suivi. In addition to being economical, this service delivers within 48 hours throughout France and offers the buyer the possibility of being delivered to his home, to a pick-up point business or to a post office. The Colissimo at home are with or without signature, at the buyer's choice. Colissimo relay points are delivered against signature and presentation of an identity document. In case of absence, if the buyer chooses home delivery and the package does not fit in the mailbox, the postman will leave a delivery notice in the mailbox, which will allow the buyer to withdraw his package at the post office during business hours, within 15 days. Please note that this notice may have slipped into the advertisements. Also, in order to recover the package, the buyer should not hesitate to go to his post office with the Colissimo tracking number sent by email on the day the order is dispatched. The buyer can also choose delivery by Chronopost for an Express shipment (see the different delivery options).

Colissimo Suivi and Chronopost are very reliable services. However, it is possible, as in any expedition, that there may be a delay in delivery or that the product may get lost. In the event of a delay in delivery compared to the supposed date, we advise first of all to check the progress of the package on the Post Office website with the tracking number :

  • Parcel delivered: check with those around you (neighbour, caretaker, concierge, etc.).

  • On the way: it should arrive soon.

  • Pending at the post office: you must collect it at your post office.

  • Return to sender: contact us.

If the delay persists, the buyer must report it by email via the contact form. We will then contact the Post Office to start an investigation. A Poste investigation can last up to 21 days from the start date of the investigation. If during this period, the product is found, it will be re-routed immediately to your home (most cases). If on the other hand the product is not found at the end of the period of 21 days of investigation, the Post office considers the parcel as lost. Only then can we send you a replacement product, at our expense. If the product(s) ordered were no longer available at that time, we would reimburse the amount of the products concerned by the loss of the carrier. In any case, Penn'Ty Bio will always seek to find a satisfactory solution for both parties. Late delivery of a package cannot give rise to compensation from Penn'Ty Bio.

No order cancellation request for non-receipt of a package will be accepted by our services beyond 60 working days from the deadline indicated for delivery of the package.

In cases where the Post office does not detect any fault of its services and therefore does not make any reimbursement, Penn'Ty Bio will not bear any costs.

Orders are generally processed the same day or the next day and delivered to the carrier as soon as possible.

The overall delivery time therefore corresponds to the order preparation time (D or D+1) + the delivery time (48 hours for Colissimo France, more for other transport, in particular international deliveries).

The days indicated are working days and therefore Saturday and Sunday are not to be taken into account. Delivery times are given for information only, as we cannot guarantee the proper functioning of carriers.

If we cannot meet these deadlines for various reasons (out of stock at the supplier, annual leave, etc.), we will inform you by email very quickly.

We decline all responsibility for products that travel at the risk and peril of the buyer. In any case, we will not be released from its obligation to deliver in the event of :

- occurrence of a case of force majeure such as in particular war, riot, fire, strikes, accidents and the impossibility of obtaining supplies.

- non-performance by the customer of any of his obligations (payment of the price, accuracy of the information communicated by the customer such as the delivery address, etc.).


Returns processing

Damaged package :

If the package presented by the postman is damaged, the buyer must refuse it and request a return to the sender. La Poste cannot charge a fee for this return. Upon receipt of the damaged package, our services will contact the Post Office to start an investigation. A Poste investigation can last up to 21 days from the start date of the investigation. As soon as we receive the conclusions of the investigation from the Post Office, we reship the products.

If the parcel is deposited directly in the mailbox by the postman and it is unfortunately damaged: the buyer must imperatively go with the parcel and without opening it, to his post office in order to ask them for a report. of deterioration. If this is not requested on the same day of delivery, the Post Office will refuse to deliver it and we will not be able to accede to any claim for compensation. Once the damage report has been recovered, the buyer must contact our customer service.

- Returns under the reason "Do not live at the indicated address" (NPAI) :

After receipt and acceptance of the package by our services, a credit note (total of the order, deducted return management costs) will be credited to the buyer's customer account within 48 hours of receipt of the package by Penn'Ty Bio. The buyer can then place an order again. Indeed, in the case of a package whose delivery address was incorrectly filled in when the order was placed by the customer and which ends up coming back to us for incorrect addressing or the mention NPAI (Does not live at the address indicated), management fees may be applied, equivalent to the shipping costs paid when placing the order. Only the products ordered will then be refunded.

- Returns under the "unclaimed" reason :

This case concerns parcels that have transited via Colissimo, which have not been claimed by the buyer at the post office or at the relay point chosen by the buyer, within the time allowed (15 days).

After receipt and acceptance of the package by our services, a credit note (total of the order, deducted return management costs) will be credited to the buyer's customer account within 48 hours of receipt of the package by Penn'Ty Bio. The buyer can then place an order again.

In the case of a parcel which was sent by Chronopost and which was not collected within the time limit (unclaimed or incorrect address), return management costs will be applied. After receipt and acceptance of the package by our services, a credit note (total of the order, deducted return management costs) will be credited to the buyer's customer account within 48 hours.



Payment for purchases is made :

  • by credit card: Visa, MasterCard, other Carte Bleue.

  • by Paypal: by connecting to your Paypal space
  • by bank check payable to PENNTYBIO (only for metropolitan France)

  • by bank transfer (contact customer service to obtain our bank details).

  • by administrative mandate for local authorities (detailed procedure on our "secure payment" page).

Any order will only be considered effective when the transaction is validated either by the banking institution or by Paypal. In case of refusal of validation, the order will be automatically cancelled.

No data (bank, address, email, etc.) concerning the buyer is stored on the penntybio.com site, thus eliminating any possibility of hacking our site.

In case of payment by bank check, it must be issued by a bank domiciled in metropolitan France.

The cashing of the check is made within 15 days of receipt of the check.

Specificity for payment by check :

1 : If you opt for delivery by chronopost, while having chosen a method of payment by check, your package will only be processed and shipped from the moment we receive your check.

2 : For an order placed by check on our shop and whose value is greater than 200 euros, we reserve the right to ask you for a bank check or payment for your order by bank transfer. In all cases, a bank check may be requested, thus delaying the sending of the goods until a favorable return has been made by the banking organization.

3 : For a first order placed by check on our shop, the value of which is greater than 70 euros, we reserve the right to request a bank check from the competent body. A delay in sending the goods may therefore take place as long as a favorable return has not been made by the banking institution.

4 : Attention: an order awaiting payment will be automatically canceled after one month.

Right to retract

As soon as your return has been processed, we will send you an email informing you of the refund or the sending of the product in exchange.

Penn'Ty Bio will not refund or exchange any items :

  • Incomplete, used, damaged, damaged, opened or soiled by the recipient.

  • Not delivered intact with their labels in their original packaging (if present).

  • Having caused an allergy.

Guarantee of conformity of goods

The compliance of the property will be carried out within a maximum of 30 days following the buyer's request.

Penn'Ty Bio will not ask the buyer for any costs for the replacement, repair, resolution or reduction of the contract except possibly postage costs reimbursed to the buyer within 14 days.

If the goods cannot be brought into conformity within 30 days of the buyer's request, and only on this condition, Penn'Ty Bio will proceed with the resolution of the sale (i.e. that the buyer returns the goods and Penn'Ty Bio reimburses the price on the date of purchase of the goods).

Penn'Ty Bio would like to point out that the conformity guarantee does not cover malfunctions due to negligence or improper use of the product in question (disrespect of the instructions for the installation and/or use and maintenance of the product) . If the malfunction results from negligence or inappropriate use, this will definitively cancel the guarantee of conformity of the good. Special cases Guarantee of Conformity for essential oil diffusers

The proven failure rate of our diffusers over the first year is less than 0.5%. In the event of malfunction of one of our diffusers under warranty (up to 2 years after the date of purchase), we advise the buyer first to consult and apply the maintenance advice presented in the instructions for the appliance and/or in our thematic file “Maintaining your diffuser”.

If the problem persists, the buyer must follow the following procedure :

It should be noted that any returned product resulting from negligence or inappropriate use will definitively cancel the guarantee of conformity of the good. In addition, the cost of returning the diffuser (if it has already been returned) will remain the responsibility of the buyer.

B – Reshipment of the diffuser

Unless we advise otherwise, the buyer must return the entire diffuser (pump, glassware and possibly transformer) in correct packaging that will withstand transport. If we have validated the implementation of your distributor's guarantee of conformity in advance, a prepaid RETURN label will be sent to you.

The buyer must provide the original purchase invoice.

No support will be accepted without this document.

The return address will be specified on a case-by-case basis by our services. Please do not return your diffuser without our agreement.

A standard repair or exchange carried out during the conformity warranty does not affect the expiry date of this warranty.
